“The penalty for not acquiring the corresponding CELs is a fine that is determined according to the percentage of CELs not acquired in the period * and to recidivism. The seriousness of the infraction, the economic capacity of the offender, recidivism, the commission of the fact that motivates it or any other element from which the severity or lightness of the infringing act can be inferred, including the actions taken to correct it, will also be taken into consideration. The fine will be 6 to 50 minimum wages per MWh of non-compliance, that is, for each CEL not acquired. The fine does not exempt the participant from buying the CELs, so the participant must acquire the CELs that caused the sanction within the same period that is given to pay the fine.
