The National Regulatory Improvement Commission (Conamer) published an agreement on Wednesday through which the Ministry of Energy (Sener) seeks to modify the second transitory article of the guidelines for the granting of Clean Energy Certificates (CELs) .

On October 28, the Sener amended the regulation so that all legacy power plants of the Federal Electricity Commission (CFE), which produce electricity via clean energy, can be candidates to issue such certificates, which were previously exclusive to plants ‘greens’ built after 2014.

The Sener changed the wording of the transitory one that assured that “the certificates of clean energies granted in favor of clean power plants and bequeathed power plants, will only be able to accredit the production of electric energy based on sources of clean energy from the entry into force of this agreement, so it will not have its effects with respect to acts carried out before that date ”.

In the new agreement, Sener omitted the part that involves clean power plants. This is because with the previous wording that dependence invalidated all the CELs that the national power company received after 2014, with the construction of hydroelectric plants and the increase in capacity at the Laguna Verde nuclear power plant, and only made valid the certificates that will be issued after October 28.

“The guidelines that they corrected (last October) what they did is that as of the day of publication, legacy exchanges could be accredited CELs, but what they did (with the incorrect wording) was to invalidate the previous certificates” , explained Víctor Ramírez, sector specialist and spokesperson for the Mexico, Climate and Energy Platform.

The change that Sener sent to Conamer, and which he requests is exempt from the manifestation of regulatory impact, does not mean a setback in Sener’s decision to grant certificates to the CFE, the specialist explained.”
